This memorial website was created in the memory of our loved one, Brianna A. Moore who was born in California on November 01, 1989 and passed away on August 28, 2004 at the age of 14. she was in a Fatal Car Accident with 5 kids in the car. when the 18 year old driver was drunk that nite and Calling Out Speeds of 80, 85, 90, 100, 120 MPH.  As He Kept On Speeding When Everyone In the Car was Yelling at Him to Stop Speeding, Slow Down, Stop  But he just kept showing off and lost control of his car and hit a tree. Hit it so hard that the tree fell over and the car landed on Top of it on its side, Crushing her in the back seat.  They could hardly find her. They took her to the Hospital where she died on the Operating Table.  I was Devastated,  what a terrible day that was for her and I. The hardest thing was seeing her on the bed not breathing and leaving the Hospital with out her. She was at her Dad's house for the weekend and I got a Phone call I will never forget.. 

This Accident Happened at Marina HIlls Dr & Niguel Rd on August 28
There were 22 units called out and 14 calls to 911...
This Accident should not be taken Lighty... 5 people were injuried and a little Girl died & never got to start her life

The primary responsibility of the driver is to operate a motor vehicle safely. The task of driving requires full attention and focus. Cell phone use can distract drivers from this task, risking harm to themselves and others. Therefore, the safest course of action is to refrain from using a cell phone while driving. 


Q. Does cell phone use while driving cause traffic crashes?

A. Research shows that driving while using a cell phone can pose a serious cognitive distraction and degrade driver performance. The data are insufficient to quantify crashes caused by cell phone use specifically, but NHTSA estimates that driver distraction from all sources contributes to 25 percent of all police-reported traffic crashes.

Q. Is it safe to use hands-free (headset, speakerphone, or other device) cell phones while driving?

A. The available research indicates that whether it is a hands-free or hand-held cell phone, the cognitive distraction is significant enough to degrade a driver’s performance. This can cause a driver to miss key visual and audio cues needed to avoid a crash.

Q. In an emergency should I use my cell phone while driving?

A. As a general rule, drivers should make every effort to move to a safe place off of the road before using a cell phone. However, in emergency situations a driver must use their judgment regarding the urgency of the situation and the necessity to use a cell phone while driving.

Q. Is NHTSA conducting further research to better quantify the safety impact of using cell phones while driving?

A. NHTSA is conducting research projects on driver cell phone use and will continue to monitor the research of others on this subject. As we learn more about the impact of cell phone use on driver performance and crash risk, and as wireless technologies evolve and expand, NHTSA will make its findings public.

Q. Is talking on a cell phone any worse than having a conversation with someone in the car?

A. Any activity a driver engages while driving has the potential to distract the driver from the primary task of driving. Some research findings comparing cell phone use to passenger conversations while driving, show each to be equally risky, while others show cell phone use to be more risky. A significant difference between the two is the fact that a passenger can monitor the driving situation along with the driver and pause for, or alert the driver to, potential hazards, whereas a person on the other end of the phone line is unaware of the roadway situation.

Q. What do the studies say about the relative risk of cell phone use when compared to other tasks like eating or drinking?

A. The current research does not provide a definitive answer as to which behavior is riskier. In a controlled study, comparing eating and operating a voice-activated cell phone to continuously operating a CD player, it was found that the CD player operation was more distracting than the other activities. In a test track study conducted by NHTSA, the results showed that manual dialing was about as distracting as grooming/eating, but less distracting than reading or changing CDs. It is also important to keep in mind that some activities are carried out more frequently and for longer periods of time and may result in greater risk.

New Laws for 2008 - Driver License
Unless otherwise indicated, these new laws become effective on January 1, 2008.


Driving Under the Influence Repeated Offense — Operative January 1, 2009
Amend and Add: Vehicle Code §§13353.1, 13353.2, 22651, 42009, 422010 13389, and 23154 (AB 1165 Chapter 749)

Makes it unlawful for a person who is on probation for a driving-under-the-influence offense to operate a motor vehicle at any time with a blood-alcohol concentration of 0.01 percent or greater.
Imposes an admin per se driver license suspension on persons found to violate this prohibition.

Medical Examination for Special Certificates
Amend: Vehicle code §12517.2 (AB 139 Chapter 158)

Authorizes the medical examination for an original or renewal certificate to drive a schoolbus, school pupil activity bus, youth bus, general public paratransit vehicle, or farm labor vehicle to be given by a licensed, advanced practice, registered nurse qualified to perform a medical examination or by a licensed physician assistant.

Required Declaration on an Original or Renewal Application for a Driver License — Operative July 1, 2008
Add: Vehicle Code §13385 (AB 808 Chapter 748)

Requires an applicant as a condition of obtaining or renewing a driver’s license to sign a declaration acknowledging that a driver may be charged with murder if a person is killed as a result of driving under the influence.


Smoking in Vehicles With Minor Passengers
Add: Health and Safety Code Article 2.5 to chapter 4 of Part 15 of Division 104. Amend: Vehicle Code §12814.6 (SB 7 Chapter 425)

Makes it an infraction punishable by a fine not exceeding one hundred dollars ($100) for a person to smoke a pipe, cigar, or cigarette in a motor vehicle any time a minor is present in the vehicle.

Speed Contests and Reckless Driving
Amend: Vehicle Code §§11110, 11215, 12810, 13201, 13351, 13352, 14601, 21051, 23103, 23104, 40800, 40804, 41610, 42008.5, 42009, and 42010 (AB 430 Chapter 682)

Includes reckless driving on a highway, reckless driving in an off-street parking facility, or exhibition of speed on a highway within the scope of various other existing statutes.

Traffic Violations Adjudication
Amend: Penal Code §1203.4 Vehicle Code §§40501, 41501, and 42005 (AB 645 Chapter 161)

Prohibits the courts from dismissing serious traffic violations through completion of a traffic violator school program or any other court-approved program for safe driving. Serious traffic violations are those that would result in the assessment of two negligent operator points.

Wireless Telephones and Mobile Service Devices — Operative July 1, 2008
Amend and Add: Vehicle code §§12810.3, 23123, and 23124 (SB 33 Chapter 214)

Prohibits a person under the age of 18 from driving a motor vehicle while using a wireless telephone, even if equipped with a hands-free device, or while using a mobile service device, as defined.
